The legal challenge brought by the NAACP pointed to a 2021 court-enforced settlement that legally obligates the Postal Service to prioritize election mail delivery through 2028.
However, the appellate panel ruled that the administration faced irreparable harm if barred from finalizing regulations before the upcoming general election.
“In this context, 'there can be no do over' once the election occurs,” the ruling said.

Circuit ruling permits the agency to continue its rulemaking process, a separate injunction issued in Massachusetts remains active for 23 states and the District of Columbia.
Official agency representatives declined to elaborate on the ongoing multi-state legal proceedings.
