Critics argue that brokered sales undermine franchise agreements, distort allocation systems, and create uneven competition.

Supporters, however, claim brokers provide a smoother experience and spare buyers from traditional price negotiations.

Violates State Law

New Jersey's Motor Vehicle Commission reminded dealers earlier this year that brokering new-car transactions violates state rules and could threaten dealer licenses.

Regulators appear increasingly willing to enforce laws that were previously viewed as dormant.

Dealers themselves are divided. Some want tougher enforcement, believing competitors are gaming manufacturer incentive programs through broker-heavy sales.

Others question whether automakers will consistently enforce the policies, given that higher sales volumes still benefit the brands.

Proving broker involvement remains a practical challenge, as brokers can remain invisible unless paperwork explicitly reveals payments or third-party coordination.

Nonetheless, the auto industry's tone has clearly shifted, and what was once tolerated is now being shut down.
