A California couple has filed a lawsuit against a daycare facility after their 23-month-old son suffered a traumatic brain injury and hearing loss in an incident involving a worker.

The lawsuit targets the Bay Club Clubhouse in El Segundo, California, following a March 2025 event where an employee allegedly tossed the toddler into the air and failed to catch him.

According to the legal filing, video footage shows the worker playfully swinging the child, identified as C. K.

, before tossing him above her head. Both fell to the ground, with the worker landing on top of the boy.

The parents, Matt and Elena Kittle, said the incident caused severe and ongoing medical complications.

The family held a membership at the Manhattan Country Club, which provided childcare at the clubhouse without extra fees.

On the morning of the incident, the father dropped his son off around 8:35 a. m.

, according to court documents.

The lawsuit states that the father received a call from the Bay Club saying C. K.

had fallen and calmed down.

The staff member said she did not think they needed to pick him up but wanted them to know about the incident.

Fifteen minutes later, the daycare called again, requesting that the child be collected immediately because they could not settle him down.

An employee allegedly told the father the toddler had fallen from a height of one and a half feet.
